Receiving red letters of demand for old debt or debt you never knew existed?
Here is some useful info:
A creditor has 3 years in which to take legal action against any debtor, after 3 years as long as you have not agreed to this debt telephonically or by letter the debt will have prescribed (Expired). If you agree you owe the debt and/or start making monthly payments the 3 year period is revived. They will never take you to court cause they know the case will be thrown out of court as, the debt has prescribed long ago and then will not be able to harass you any more. Prescribed debt however does not apply to muncipal debt or mortgage debt.
Many of these businesses buy up old debt from liquidated companies which are in essence just spread sheets, they have no actual documentation of the actual accounts which you may have signed or statements pertaining to the accounts. You wont get detailed reports of the account from them and/or letter of settlement.
In many cases collection companies have premium lines installed, their letter demands you phone their call centre so they can keep you on the phone for as long as they can. This is to make money from your call through their premium line.
Do not phone them, send an email or registered letter demanding detailed statements of your account. Keep a copy of your email or letter for your records, invite them to furnish you with this documentation within 7 days or take you to court. It is important for you to communicate that you have knowledge of the prescribed debt act and that the debt they claim you owe has prescribed.
It is illegal to list people for prescribed debt.
